Bezdek v. Vibram USA, Inc., 15-1207
In an appeal brought by objectors to a class action settlement concerning allegedly deceptive advertising and marketing claims made about the health benefits of certain "barefoot" running shoes, the district court order approving settlement and awarding attorneys' fee is affirmed where the court: 1) carefully explained its reasons for rejecting the claims; 2) did not abuse its discretion in deciding that the settlement terms were fair, adequate, and reasonable; and 3) did not abuse its discretion in awarding attorneys' fees.
