United States First Circuit
Municipio Autonomo de Ponce v. US Office of Management, 14-2287
In a case concerning the Ryan White Comprehensive AIDS Resources Emergency Act, 42 U.S.C. section 300ff et seq., under which the U.S. Department of Health and Human Services (HHS) disburses funding to combat HIV/AIDS infection in metropolitan areas that are home to more than a specified number of individuals who have AIDS, arising after HHS determined that the Ponce metropolitan area no longer has enough AIDS cases to qualify for continued funding, the district court's judgment, declaring the metropolitan boundaries of Ponce unlawful, is reversed where Congress can reasonably be said to have dictated that HHS use the boundaries that it uses in defining the Ponce metropolitan area.
