Bradley v. Sugarbaker, 15-1128

In a medical malpractice action, in which plaintiff was injured in the course of determining whether a mass on her lung was cancerous, the district court's judgment is: 1) affirmed as to dismissal of plaintiff's battery claims; but 2) vacated and remanded with respect to the excluded expert testimony that a fine-needle aspiration (FNA) biopsy was a viable non-surgical alternative to a surgical biopsy.
