US Liability Ins. v. Benchmark Construction Service, 14-1832
In a declaratory judgment action involving the scope of an employer's liability exclusion in a dispute over the insurer's duty to defend and indemnify insured in an underlying personal injury action, the district court's conclusion that insurer had no duty to defend or indemnify is reversed where, given the ambiguities in the exclusion, they must be construed in the insured's favor.
