US v. Jimenez-Bencevi, 13-2084

Conviction for of tampering with a federal witness, possession of a firearm in furtherance of a crime of violence, use of a firearm during and in relation to crimes charged in the indictment, and use of a cell phone in attempting to commit kidnapping, is reversed where the district court improperly violated the immunity agreement with the government when it insisted that a defense expert be informed of a proffer made in an attempt to negotiate a plea.
