Conviction of possession of child pornography in violation of 18 U.S.C. section 2252A(a)(5)(B), the district court's denial of defendant's motion to suppress evidence is reversed and remanded where where the district court erred in ruling as a matter of law that an affiant never has a duty to make further inquiry before presenting a warrant application to a magistrate.
