Goguen v. Allen, 13-2278

In this case, plaintiff is a former pretrial detainee at the Somerset County Jail. Plaintiff brought this action alleging that various correctional officers at the jail violated his rights under the First, Eighth, and Fourteenth Amendments by inflicting punishment on him without due process of law and by retaliating against him for filing grievances against staff members. The district court granted summary judgment to several defendants who had not participated personally in the alleged violations, but determined that there were genuine issues of material facts concerning the remaining defendants' actions and motivations that precluded summary judgment. These remaining defendants timely appealed. The appeal must be dismissed, where: 1) defendants have not come forward with any purely legal issues that call into question the district court's denial of their motion for summary judgment on qualified immunity grounds; and 2) consequently, this court does not have jurisdiction over defendants' appeal.
