Klunder v. Brown University, 13-1769

In a suit brought by a student who was removed and suspended from a university, alleging the school's handling of his disciplinary procedures and removal violated both his constitutional rights (under 42 U.S.C. Section 1983) and Rhode Island state law, the District Court's judgment in favor of the school is affirmed where: 1) the school was not a state actor subject to suit under Section 1983; 2) it was not error to allow school to amend its answer to include a statute of limitations defense; and 3) there is no merit to the claim the ignoring Rhode Island's tolling statute would have brought plaintiff's claims within the three-year statute of limitations.
