United States First Circuit

Winfield v. O'Brien, 13-2438

The district court's denial of petitioner's petition for a writ of habeas corpus seeking to invalid his conviction for assaulting and raping a two-year-old child is affirmed, where, given petitioner's opportunity to commit the offense was materially greater than that of the only other possible perpetrator, and given that the expert evidence and the phone call cast heightened relevant focus on the time when petitioner was alone with the child, Massachusetts courts could have reasonably concluded that a rational jury could have found petitioner guilty beyond a reasonable doubt.
