United States First Circuit
Universal Truck & Equipment Co. v. Southworth-Milton, Inc., 13-2070
In this breach of contract action, defendants invoked diversity jurisdiction and removed the lawsuit to federal court. Denial of plaintiffs' motion to remand, summary judgment in favor of defendant, and award of attorneys' fees is affirmed, where despite defendants' failure to comply with statutory removal requirements, a remand to state court is not required because complete diversity existed at the time of judgment, and plaintiffs failed to object to the procedural defect in a timely manner.
