US ex rel. Wilson v. Bristol-Myers Squibb, 13-1948
Following the government's settlement of certain False Claims Act (FCA) claims the relator brought in his original complaint against defendants, and the government decision to decline to intervene in the litigation of the remaining claims, the dismissal of the remaining FCA claims contained in the relator's Second Amended Complaint is affirmed, where the district court did not err in finding that the Second Amended Complaint ran afoul of the first-to-file rule.
