United States First Circuit
Wang v. Holder, 13-1767
The Board of Immigration Appeals's (BIA) order denying petitioner's motion to reopen removal proceedings is affirmed, where the BIA did not abuse its discretion in finding that: 1) tolling was unwarranted because the petitioner had not shown that he exercised due diligence during the nearly two decades since his removal was first ordered; and therefore, 2) petitioner's third motion to reopen was untimely.
