Defendant's ninety-seven month prison sentence imposed by the district court after he pled guilty to a drug conspiracy charge is vacated and remanded for resentencing, where: 1) the waiver of appeal in defendant's plea agreement does not bar defendant's appeal; 2) the consecutive sentence to an earlier sentence for a related conviction was not improper; but 3) the district court's Sentencing Guideline calculation error requires remand for resentencing.
