United States First Circuit

Rivera-Velazquez v. The Hartford Steam Boiler Inspection and Ins. Co., 13-1301

In an employment discrimination suit, the District Court's denial of plaintiff's Rule 60(b) motion is affirmed where: 1) an attorney's illness does not constitute a per se justification for Rule 60(b) relief; 2) the district court did not abuse its discretion when it identified the relevant factors, weighed them with care, and reached a defensible conclusion; and 3) none of plaintiff's remaining criticisms makes a dent in the district court's determination.
