Valsamis v. Gonzalez-Romero, 13-1419
Judgment for defendant in an action to collect on a loan is affirmed, where: 1) the district judge's bench decision adequately conveyed both his assessment of the facts and the rationale for his decision, and thus, the judge substantially complied with the requirements of Federal Rule of Procedure 52(a)(1); and 2) the district judge applied the appropriate standard in requiring that plaintiff had the burden of proving the crucial fact, the identity of the borrower, by a preponderance of the evidence.
