Redondo Construction Corp. v. Izquierdo, 13-1834

Summary judgment for defendants in an action in which plaintiff alleges that defendants were in breach of certain settlement agreements with it, which caused its bankruptcy and damages, is: 1) affirmed in part, as to defendant Puerto Rico Highway and Transportation Authority (PRHTA) and the individual defendants, where plaintiff has no record evidence of damages against these defendants; but 2) vacated in part and remanded, as to the dismissal of the claim against defendant Puerto Rico Public Buildings Authority (PBA), where plaintiff was never put on notice that entry of judgment was a possibility, nor was it given the opportunity to present its evidence to avoid that result.
