United States First Circuit

US v. Jacques, 12-1016

Defendant's convictions of conspiracy against civil rights, damage to religious real property, and the use of a fire to commit a felony, for his participation in the he arson of an African-American church are affirmed, where: 1) defendant provided his confession knowingly and voluntarily; 2) the brief delay in acquiring defendant's waiver of his right to presentment was not "unreasonable and unnecessary" so as to merit suppression of his statements; 3) the district court did not err in concluding that Jacques's waiver was knowing, intelligent, and voluntary; and thus, 4) the district court did not in admitting defendant's confession into evidence.
