Summary judgment for defendants in plaintiff's action alleging copyright infringement and contract claims concerning seven songs ultimately released on an album distributed by the defendants is affirmed, where: 1) there was a lack of evidence as to whether the copies plaintiffs submitted to the Copyright Office met all of the requirements for deposit copies and the Copyright Office had not yet taken a position on whether it had received all of the required materials for registration; 2) plaintiff Rivera fails to specify a specific contract between Rivera and the UMG defendants, and plaintiffs' third party beneficiary claims also fail; and 3) the district court did not abuse its discretion in denying plaintiffs' motions for transfer and additional discovery.
