Atlantech Incorporated v. American Panel Corporation, 13-1437

In an action arising out of plaintiff's claims against defendant related to the alleged breach of various agreements involving the sale of aviation equipment, the district court's orders on post-trial motions resolved partially in plaintiff's favor and partially in defendants' favor are affirmed, where: 1) the district court correctly concluded that plaintiff did not prove direct damages resulting from the alleged repudiation of the 1040 MOA Agreement, and the plain terms of the contract preclude recovery for other types of damages; 2) the district court did not err in its holding that plaintiff had waived the issue of pre-judgment interest; and 3) the district court did not err in upholding the jury's award of damages for defendant's breach of the 2006 Purchase Agreement.
