United States First Circuit

US v. Delgado-Marrero, 11-1660

Defendant's convictions and sentences on drug and gun charges are: 1) vacated as to defendant Delgado's conviction, where the district court committed reversible error by excluding the testimony of a defense witness; 2) reversed in part as to defendant Rivera's sentence, where, under Alleyne v. United States, which applies retroactively, the district court plainly erred in articulating the jury instructions imparted in connection with a post-verdict special jury form; but 3) otherwise affirmed, where defendant Rivera's other claims of error fail.
