United States First Circuit
Pina v. Children's Place, 13-1609
Summary judgment in favor of defendants on plaintiff's claims of employment discrimination and retaliation is affirmed, where: 1) the district court did not err in denying plaintiff's discovery related motions; 2) plaintiff failed to establish a prima facie case of discrimination; 3) even if she could, her claim still fails because plaintiff was unable to rebut defendants' legitimate, nondiscriminatory basis for her termination with evidence of pretext and discriminatory motive; and 4) plaintiff failed to establish a prima facie case of retaliation.
