The bankruptcy court's determination that defendants have a real property interest in an apartment that is part of a timeshare real estate venture undergoing Chapter 11 bankruptcy proceedings is affirmed, where: 1) under the Puerto Rico Timeshare and Vacation Club Act, recordation of special real property rights is an option, not an obligation; and 2) plaintiff failed to challenge on appeal the bankruptcy court's finding regarding the intention of the parties as to the creation and transfer of real property interests.
