Rosales-Perez v. Holder, 12-1377
The Board of Immigration Appeals (BIA) properly denied petitioner's motion to reopen his removal proceedings, where: 1) the BIA did not misapply the materiality standard where it evaluated whether the new evidence showed that a "different outcome is warranted" in petitioner's case; and 2) the BIA did not abuse its discretion in finding the new evidence was not material.
