US v. Breton, 12-2293
Defendant's conviction and sentence for producing, possessing, and distributing child pornography is affirmed, where: 1) the district judge did not err by recognizing an exception to the marital communications privilege for offenses against a spouse's child and applying the exception to the statements at issue here; 2) the district court did not err in admitting file and chat room names that were suggestive of child pornography where no images were recovered; 3) sufficient evidence supported all three charges; and 4) the district judge did not err in calculating defendant's sentence.
