United States First Circuit
Wu v. Holder, 12-1685
The Board of Immigration Appeals (BIA) properly dismissed petitioner's appeal of an Immigration Judge's (IJ) order denying his applications for relief from removal, where: 1) the BIA erred in concluding that the REAL ID Act applied to petitioner's case but that error did not affect the case; 2) petitioner fails to establish past persecution based on the deprivation of his ability to father more children; and 3) petitioner did not establish a well founded fear of future persecution in response to either his resistance to China's coercive population control program or his illegal departure.
