US v. Clemens, 12-1149

Defendant's conviction on two counts of sending threats to injure another across state lines in violation of 18 U.S.C. section 875(c) is affirmed, where: 1) an objective test of defendant's intent is used to determine intent under true threat statutes; 2) the district court did not err in its jury instructions; 3) sufficient evidence supports his conviction; and 4) the district court did not err in denying defendant's pre-trial motion to dismiss his indictment.
