United States First Circuit

US v. Rivera-Lopez, 13-1060

Defendant's appeal of two conditions of his supervised release, for a nighttime curfew and twenty-four-hour electronic monitoring, is dismissed, where: 1) defendant was sentenced on narcotics and firearms charges pursuant to a plea agreement containing a waiver-of-appeal provision; 2) the conditions are so clearly erroneous and unsubstantiated as to work a miscarriage of justice; and thus, 3) defendant's knowing and voluntary waiver of appeal bars his instant challenge.
