Summary judgment for defendant-employer on plaintiff's claims that defendant improperly handled his request for leave under the Family and Medical Leave Act (FMLA) and forced him to resign in retaliation for seeking such leave, is affirmed, where: 1) plaintiff was not eligible to take FMLA leave; 2) plaintiff has not established that the defendant's handling of his FMLA leave application caused him any harm; 3) defendant did not unlawfully retaliation against plaintiff; and 4) plaintiff's state law claims are without merit.
