Following settlement of part of a construction dispute between the case's diverse parties, judgment for the third party plaintiff construction company against defendant hotel is affirmed, where: 1) the district court did not abuse its discretion in exercising jurisdiction over the third party plaintiff's supplemental state law claims against defendant; and 2) the district court did not err in its interpretation of the contract in calculating damages.
