Awuah v. Coverall North America, Inc., 12-2495

In a dispute between plaintiff-franchisees and defendant-franchisor, the district court's denial of defendant's motion to reconsider sanctions imposed on it, and to stay proceedings pending arbitration, is reversed and remanded, where: 1) the district court abused its discretion in determining that defendant had violated an order requiring it to obtain judicial permission before making any motion to delay or prevent arbitration proceedings; 2) without this improper determination, there was no basis for the sanction; and thus, 3) defendant's motion to stay should have been granted.
