United States First Circuit

Soto-Hernandez v. Holder, 12-1269

A petition for review of a Board of Immigration Appeals (BIA) decision holding that petitioner's prior conviction for the unlawful transfer of firearms rendered him statutorily ineligible for cancellation of removal, is denied, where the BIA's determination that petitioner's one-time sale of a single firearm constituted "trafficking in firearms" under 8 U.S.C. section 1101(a)(43)(C) involved a permissible construction of the Immigration and Naturalization Act (INA).
