Aguirre v. Holder, 12-1063
A petition for review of an order denying petitioner's application for suspension of deportation, a form of relief that was available to certain non-citizens before 1996 and required a showing of seven years of continuous physical presence, is: 1) denied in part, where the stop-time rule of the Immigration Reform and Immigrant Responsibility Act of 1996 (IIRIRA) applies retroactively to petitioner, and petitioner has not accrued the necessary years of physical presence under this rule; and 2) dismissed in part, where petitioner never raised the a repapering-based claim so there is no jurisdiction to hear this argument.
