US v. Russell, 12-1315
Defendant's conviction of making false statements in connection with the payment of health care benefits is affirmed, where: 1) the district court properly instructed the jury that the government need only prove that the defendant's statements were false and that the defendant knew they were false; 2) the government presented sufficient evidence that his alleged false statements were material; 3) the district court did not err in excluding testimony by a witness about defendant's state of mind when applying for a job with Boston Financial in 2010; and 4) defendant's multiple claims of prosecutorial misconduct fail.
