Kinisu v. Holder, 12-2444

The Board of Immigration Appeals (BIA) did not err in affirming the ruling of an Immigration Judge (IJ) that petitioner had not met the standard for waiver of the usual requirement of filing a joint petition with a spouse in order to remove the conditions from his conditional permanent residency, where: 1) there is no jurisdiction to address arguments not raised before the BIA; and 2) the IJ's decision was supported by substantial evidence on the record as a whole.
