Portugues-Santana v. Rekomdiv International, Inc., 12-1178

In consolidated cases involving judgment for plaintiff on his action alleging breach of contract and "dolo," that defendants' false representations as to the availability of a franchise fraudulently induced plaintiff to enter into the contract, and dismissal of defendants' action for legal malpractice against their attorney, are affirmed, where: 1) Puerto Rico law does not require that plaintiff's damages award be reduced by the settlement amount in this case's verdict because the jury was directed only at these defendants' conduct and not the other settling parties; and 2) the allegations in defendant's legal malpractice complaint fail to establish the causation element necessary to make out a plausible legal malpractice claim under Puerto Rico law.
