Newman v. Krintzman, 12-1995

Dismissal of plaintiffs' complaint against defendant alleging default on a promissory note is affirmed, where: 1) a limitations dismissal is an on-the-merits decision that carries claim-preclusive effect; and 2) here, the prior judgment dismissing the case as time-barred under New York law precludes this later suit on the same claim in another jurisdiction involving a longer, unexpired limitations period.
