US v. Zorrilla-Echevarria, 12-1261
Following defendant's convictions on charges of bulk cash smuggling and failure to report the export of currency, the United States may now retain the nexus property in satisfaction of the money judgment entered against defendant, where: 1) defendant has been found by a jury to be guilty of the crimes charged; 2) the statute clearly provides for forfeiture of the cash used in the attempted smuggling; 3) that very cash is undisputedly available for forfeiture; and 4) the rights of all possible third parties have been adjudicated.
