Moreta v. Holder, 12-1902

The Board of Immigration Appeals (BIA) did not err in affirming an Immigration Judge's (IJ) finding that petitioner abandoned her applications for relief from removal, where: 1) the IJ acted within her discretion in finding that plaintiff had abandoned her applications for relief by missing the filing deadline; and 2) since the BIA's and IJ's finding as to abandonment was not an abuse of discretion, the BIA was under no obligation to address the IJ's alternative findings, or petitioner's arguments based on those findings.
