Valdez Lopez v. Holder, 12-2261

The Board of Immigration Appeals (BIA) decision denying petitioner's untimely motion to reopen his concluded removal proceedings, is affirmed, where the BIA did not abuse its discretion in: 1) finding that none of the evidence introduced calls into question its and the Immigration Judge's earlier determination that petitioner's fear is one of personal retaliation, not one of persecution on account of a protected ground; and 2) determining that the evidence introduced does not reveal increased lawlessness in Mexico sufficient to amount to changed country conditions, much less a change material to petitioner's claim.
