United States First Circuit

Joyce v. Town of Dennis, MA, 11-1887

Following judgment in favor of plaintiff on her claim of gender discrimination arising out of defendants' denying her entry into a men's golf tournament, the district court's orders regarding her damages are: 1) affirmed as to the district court's refusal to instruct the jury on punitive damages; but 2) the denial of injunctive relief and the award of attorney's fees are vacated, and the matter is remanded for further proceedings on the injunctive relief because the court must conduct the four-factor inquiry set out by precedent and explain its decision, and on attorney's fees, because the district court erred in reducing the requested award based on, inter alia, plaintiff's rejection of a settlement offer.
