Boston Property Exchange Transfer Co. v. Iantosca, 11-2475
Dismissal of plaintiff's claims that defendants and their lawyers mishandled an arbitration against a third party, PaineWebber, that plaintiff had assigned to defendants to satisfy a state court judgment, is affirmed, where: 1) the appeal is timely now as to all defendants; 2) as to the tort claims, plaintiff failed to provide any evidence to meet an essential element of each, that the defendants caused it to suffer damages; 2) as to the breach of contract claim, the assignment order was not a contract; and 3) the district court's dismissal as to the attorney defendants and the Connecticut Unfair Trade Practices Act claim were also proper because plaintiff failed to provide evidence of causation of damages.
