US v. Mahoney, 12-1882
The district court's order finding defendant incompetent to stand trial and committing him to the custody of the Attorney General for hospitalization and treatment is affirmed, where: 1) the requirements of the collateral order doctrine are present here; 2) the matter is not moot; and 3) the district court did not clearly err in concluding that defendant was incompetent based on Dr. Mart's testimony and its own observations of his behavior.
