Nieves-Romero v. US, 12-1193

Summary judgment for defendant in personal injury action arising out of an alleged dangerous condition on defendant's premises is affirmed, where: 1) there is no significantly probative evidence of the defendant's actual or constructive knowledge of the alleged dangerous condition; and 2) the district court did not abuse its discretion in ruling on the summary judgment motion prior to the expiration of the extended discovery period.
