US v. Dapolito, 12-2023

The district court properly granted defendant's motion to suppress evidence, a firearm, as the fruits of an unconstitutional detention is affirmed, where the district court did not err in finding, that under the totality of the circumstances, the police did not have reasonable suspicion to believe that the defendant had been or was going to be engaged in a crime, and the consensual inquiry (with which defendant complied) cannot be converted into an investigatory stop.
