United States First Circuit

Campos v. Van Ness, 12-1109

District court's denial of defendants' summary judgment motion in 1983 action arising out a police shooting, is affirmed, where: 1) defendants have not demonstrated that plaintiff's version of the facts is so blatantly contradicted by the record that no reasonable jury could believe it; and 2) nor have defendants attempted, in the alternative, to accept all of plaintiff's facts and inferences as true and argue that even on plaintiff's best case, they are entitled to immunity.
