Hann v. Educational Credit Management, 12-9006

Summary judgment for plaintiff in suit challenging defendant-creditor's attempts to collect on a law school student loan in violation of the bankruptcy court's discharge injunction is affirmed, where: 1) the bankruptcy court's Claim Order was based on the conclusion that plaintiff had repaid her loans in full; and 2) the bankruptcy court's imposition of sanctions against defendant was proper because defendant's collection activities constituted an abuse of the bankruptcy process.
