US v. Gates, 10-2163
Defendant's conviction and sentence for drug-trafficking charges is affirmed, where: 1) defendant's motion to suppress the fruits of both a motor vehicle stop and a residential search were properly denied; 2) in the ordinary course and within the confines of the Speedy Trial Act (STA) exclusion provisions, defense counsel has the power to seek an STA continuance without first informing his client or obtaining his client's personal consent, the district court complied with the STA's exclusion provisions in granting these contested continuances, and defendant's challenges to other excluded periods were not raised below and are waived; 3) the district court acted well within its discretion in concluding that defendant had not shown a fair and just reason for withdrawing his guilty plea; and 4) defendant was fairly sentenced.
