US v. Maldonado, 12-1012
Convictions on multiple counts for drug and weapons offenses is affirmed, where: 1) defendant was not deprived of his Sixth Amendment right to counsel when the district court denied his continuance request to substitute in his sixth attorney, after multiple delays including nine continuances, and no prejudice resulted from the denial; 2) the district court did not abuse its discretion in denying defendant's request for a competency evaluation; 3) defendant must pursue his ineffective assistance of counsel claim, by filing a motion under 28 USC section 2255, not on direct appeal; and 4) the district court did not err in denying defendant's motion for a new trial.
