Drumgold v. Callahan, 11-1304

In appeal by defendant-detective from $14 million verdict for plaintiff, after jury found defendant violated plaintiff's constitutional due process rights by withholding of material exculpatory evidence during plaintiff's criminal trial, resulting in plaintiff's murder conviction, the case is remanded to the district court for a new trial, where: 1) defendant's claims that the withheld evidence was not material, that he was entitled to qualified immunity and the scope of retrial was too broad, all fail; but 2) the district court judge erred in instructing the retrial jury on causation.
