US v. Flores-Machicote, 11-2243
In appeal of sentence for possessing a firearm as a convicted felon, judgment is affirmed, where: 1) it was within the district judge's discretion to find that the defendant's criminal history score did not adequately represent either the seriousness of his past criminal behavior or the likelihood of his recidivism; 2) it was within the discretion of the court below to place special emphasis on the deterrence factor and to explain that emphasis in the context of local trends; 3) defendant's claim of unwarranted sentencing disparity fails; and 4) the five-year sentence was not substantively unreasonable.
